These Terms of Use (“Terms”) govern access to and use of the website Nugatx (“site” or “Nugatx”), owned by Nugatx Technology and Content Ltd. (“Us” or “Nugatx”), by any natural or legal person (“User”) that you visit or use. By browsing, commenting, subscribing to newsletters, downloading materials or otherwise interacting with the Site, you fully agree to these Terms, the Privacy Policy and with the Google AdSense Program Policies, which govern the display of advertisements on our pages.
1. Definitions
- Content – texts, graphics, videos, tutorials, source codes, podcasts and other information provided by Nugatx.
- Services – provision of free content, display of Google AdSense ads and interaction tools (e.g. comments, newsletters).
- Google Ads – advertising spaces provided automatically by Google, which may use cookies and similar identifiers to personalize ads for Users, in accordance with Google policies.
2. Acceptance of Terms
By using Nugatx, the User declares to have read, understood and accepted these Terms. If they disagree, they must immediately stop accessing it.
3. Provision of Service
3.1 Nugatx offers informative content about technology, applications and curiosities, partially financed by advertisements from the Google AdSense program.
3.2 The Service is made available “how are you”, without guarantees of availability, accuracy or suitability for particular purposes. There may be interruptions, errors or delays.
4. User Conduct
The User undertakes to:
- Do not commit any illegal acts, including insults, defamation, spam, phishing or exploitation of vulnerabilities.
- Do not generate artificial clicks or impressions on ads, nor encourage others to do so.
- Do not copy, sell, mirror host or reverse engineer the Content unless expressly authorized.
- Respect third party copyrights and trademarks.
5. Intellectual Property
5.1 All Content is protected by Brazilian legislation (Law 9.610/1998) and international treaties.
5.2 The use of the “Nugatx”, “Google” or “AdSense” brands is for nominative purposes only and does not imply endorsement or official partnership.
6. Advertising, Cookies and Similar Technologies
6.1 Nugatx uses its own and third-party cookies (Google) to offer, measure and personalize advertisements.
6.2 The User can disable ad personalization through the Ad Settings or sectoral initiatives such as YourAdChoices. Links and instructions can be found in our Privacy Policy.
6.3 The display of advertisements respects the Prohibited and Restricted Content Policies from Google, including restrictions on gambling, adult content, hate speech and others planned for the February and March 2025 updates.
7. Disclaimer of Warranties
The Content is provided without guarantees of accuracy, technical adequacy or real-time updating. The decision to use any information is solely up to the User, who assumes any and all risk.
8. Limitation of Liability
To the maximum extent permitted by law, Nugatx will not be liable for any direct, indirect, incidental, or consequential damages, lost profits, or lost data resulting from:
- the use or inability to use the Site;
- interaction with third-party advertisements or websites;
- of technical failures beyond our control.
9. External Links
The Site may contain links to third-party websites. We do not control and are not responsible for the content, privacy policies or practices of these websites.
10. Registration and Account Security
If the User registers (e.g.: comments, newsletter), he/she undertakes to provide truthful data, maintain the confidentiality of credentials and notify Nugatx of unauthorized use.
11. Termination and Suspension
We may suspend or terminate your access to Nugatx, in whole or in part, at our sole discretion, if you violate these Terms, the law, or the AdSense Policies.
12. Changes to these Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by notice on the Site or by email, and will become effective 15 (fifteen) calendar days after publication.
13. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, in particular:
- Internet Civil Rights Framework (Law 12.965/2014);
- General Law on the Protection of Personal Data (Law 13.709/2018).
Any dispute will be settled in the jurisdiction of the district of Sao Paulo/SP, renouncing any other, however privileged it may be.
